Terms and conditions.

1. Who we are

JB Designs is run by Josh and Bronwyn in Christchurch, New Zealand ("we", "us"). You are the business that asks us to build or host a website ("you"). By asking for a homepage draft, approving a draft, or paying an invoice, you agree to these terms.

2. The free homepage draft

When you send us the form or talk to us, we build a draft of your homepage and send you a private link, normally within two working days. The draft is free and there is no obligation. If you don't go ahead, we delete it. The draft stays our property until you pay the build fee.

3. The build: $500

The build fee is $500 and covers a five-page website (Home, Services, About, Gallery, Contact), written and designed for your business, built for phones first, with a contact form, tap-to-call, Google Maps and a link to your Google Business Profile. It includes two rounds of changes before the site goes live. A round is one collected batch of feedback.

Anything outside that scope (extra pages at $99 each, online shops, booking systems, logo design, photography, or changes after the second round) is quoted in writing before we do it.

We invoice the $500 when the site goes live. Payment is due within seven days of the invoice.

4. Hosting and care: $49 a month

The monthly plan is $49 and covers hosting, an SSL certificate, keeping your domain renewed, backups, security updates, a monthly check that your form, links and speed work, and small changes to text, images, prices, hours and staff details, done within one working day of you sending them.

Fair use. Small changes means the kind you can describe in a text message. Adding a page, redesigning a section, or a change that takes more than about thirty minutes is quoted first.

The plan starts the day the site goes live and is billed monthly in advance by card. There is no minimum term.

5. Prices

All prices are in New Zealand dollars and are the full amount you pay. We review the monthly price once a year and cap any increase at $10 a month, with at least 30 days' written notice.

6. Seven working days

We aim to have your site live within seven working days of you confirming the draft. If we miss that and the delay is ours, your first month of hosting and care is free. The seven days pause while we are waiting on you for photos, words, logo files, domain access, or approval of a draft or a round of changes.

7. Your content

You must have the right to use anything you give us: photos, logos, text, reviews. You are responsible for the accuracy of what your site says about your business, your prices and your licences. We write your copy from what you tell us; you check it before it goes live.

8. Who owns what

• Your domain name is registered in your name. It is yours.
• Your logo, photos, text and any content you gave us stay yours.
• When the build fee is paid, the finished website, as delivered, is yours to use for as long as you like.
• The design system, templates, components and tools we use to build sites stay ours. You get a finished site, not the factory.

9. Cancelling

You can cancel the monthly plan any month with a month's written notice (an email or text is fine). At the end of that month we hand you a copy of your site files and help you point your domain wherever you like. Hosting, changes and support stop; the site stays yours. We don't refund partial months.

If a monthly payment fails, we'll let you know. If it is still unpaid after 21 days we replace the site with a holding page until it is paid. We never delete your site for non-payment; we hand it over on request.

We can end the plan with a month's notice too. If we do, we hand over your files at no cost and help you move.

10. What we're responsible for, and what we're not

We keep your site online, backed up and patched. We can't guarantee any particular number of enquiries, jobs or Google rankings; nobody honestly can. If something we did is faulty, we fix it. Our total liability to you for anything to do with the site is limited to the fees you have paid us in the previous twelve months.

Because you're acquiring these services for business purposes, the Consumer Guarantees Act 1993 does not apply. Nothing in these terms limits your rights under the Fair Trading Act 1986.

11. Privacy

How we handle your information, and the information your site's form collects, is in our privacy statement.

12. The boring bit

These terms are governed by New Zealand law. If we change them, we'll tell you and put the new date at the top. If any part turns out to be unenforceable, the rest still applies.
